Scope

‘Careers in the Cloud’ is a website operated by Alliance Electric Pty Ltd (trading as Alliance SI) ABN 63 001 524 867 (Alliance SI) under the domain name www.careersinthecloud.com.au (Website). By using this site, you agree to the Privacy Policy (Policy) of the Website as published by Alliance SI and set out below.

The purpose of this Policy is to ensure that Alliance SI manages and protects personal information in accordance with the Privacy Act 1988 (Cth) (Privacy Act) and the Australian Privacy Principles (APPs).

This Policy outlines the circumstances in which Alliance SI collects personal information, how it uses and holds that information, and the disclosure of personal information. The Policy also outlines how Alliance SI manages requests for access and/or change that information. This Policy also outlines how Alliance SI manages personal information that can be used to directly or indirectly identify an individual collected through the use of Website.

For the purposes of this Policy, the term ‘Visitor’ will be used to encompass all types of people interacting with Alliance SI, including clients, customers and visitors to the Website. In addition to users of the Website, this Policy applies to all staff, volunteers and contractors of Alliance SI in the course of the provision of services by or to Alliance SI regarding this Website.

The privacy and security of Visitors to this Website and our clients are of paramount importance, so we’re committed to protecting the personal information you share with us. Any personal information is secured and accessed only by authorised personnel, with appropriate security measures in place to protect against breach or loss.

Alliance SI may, from time to time, review and update this Policy to take account of new laws and technology, changes to Alliance SI’s operations and practices and to make sure it remains appropriate to any changes in the provision of Alliance SI’s operations.

What is personal information and how do we collect it?

Personal information is information or opinion about an individual from which they can be reasonably identified. The collection of personal information depends on the circumstances in which Alliance SI is collecting it. If it is reasonable and practical to do so, Alliance SI collects personal information directly from the individual.

Website subscription

For the Website, Alliance SI collects personal information when a Visitor subscribe via the Website to our services. That is, if you are a Visitor to the Website, you may subscribe to our services and be offered various downloads, offers or services. This includes when you provide the following personal information:

  • Name, email and addresses (including residential, business, email) and other contact details including telephone number;
  • Employer information or whether you are a jobseeker;

Should you choose to subscribe via our Website (e.g. a lead-gen offer or paid product) you will be asked to agree to receive ongoing (relevant) communications. If you do not grant the requested consent, accessing the special offers may not be possible.

Depending on which offer you are accessing, your personal information will be used in one or more of the following ways:

  • Added to the Careers in the Cloud email marketing list on HubSpot, with adherence to privacy laws with strong security. When you open or click links in our emails, your action will be automatically noted so that Alliance SI can serve you better.

No credit card information is requested or stored by Alliance SI.

Cookies

Cookies are temporary, small pieces of information sent to a Visitor’s hard disk. They can’t run programs or deliver viruses, nor can they track your behaviour in alarming ways. The Facebook Pixel, LinkedIn Insight Tag and Google Analytics are all cookies used by Alliance SI, exclusively for the purpose of tracking which pages on the Website you have visited and for how long. These types of cookies are used to ensure we deliver content our Visitors enjoy and find useful, as well as to create effective marketing campaigns.

If you are on LinkedIn, Facebook or Instagram, they may result in you being shown our ads.

Although most browsers are initially set to accept cookies, you may reset your browser to notify you when you receive a cookie or to reject cookies generally. Most browsers offer instructions on how to do so in the ‘Help’ section of the toolbar.

Other

We may also use other methods to collect information on website activity such as the number of visitors, the number of pages viewed and the internet advertisements, which bring Visitors to our Website. This information is collected to analyse and improve our Website, marketing campaigns and to record statistics on web traffic. Alliance SI does not use this information to personally identify individuals.

Solicited Information

Alliance SI has, where possible, attempted to standardise the collection of personal information by using specifically designed forms in our Website subscription process outlined above.

We do not collect personal information about Visitors to our Website from other people or independent sources.

Unsolicited information

Alliance SI may be provided with personal information without having sought it through the means of collection outlined in this Policy. This is known as “unsolicited information”.

Unsolicited information obtained by Alliance SI will only be held, used and or disclosed if it is considered as personal information that could have been collected by the means outlined in this Policy. If that unsolicited information could not have been collected by normal means then Alliance SI will destroy, permanently delete or de-identify the personal information as appropriate unless it is otherwise lawful and reasonable for Alliance SI to hold, use and disclose that personal information. 

Collection and use of sensitive information

Alliance SI does not collect sensitive information from Visitors to the Website.

Information from children

We are committed to protecting the privacy of children. Our services are generally not designed for or directed to children and are only for use by Visitors who subscribe to our services via our Website who are 18 years and older. On our Website, we do not collect personal information from any person we actually know is under the age of 18. In the online space particularly, parents or guardians are urged to participate in their children’s exploration of the Internet and to teach their children about protecting their personal information while online.

How do we use personal information?

Subject to the below, Alliance SI only uses personal information that is reasonably necessary for operating the Website including the subscription service (the primary purpose) or for a related secondary purpose that would be reasonably expected by a Visitor, or for an activity or purpose to which the Visitor has consented.

In relation to personal information of a Visitor the primary purpose of collection is to enable Alliance SI to provide information to Visitors relevant to them.

Our primary uses of personal information include, but are not limited to:

  • marketing, promotional and fundraising activities
  • invitations to attend events such as webinars, industry forums

Alliance SI may share personal information to its related entities, but only, if necessary, for Alliance SI to provide our services or have services provided to it.

Alliance SI does not disclose information about a Visitor to overseas recipients and will not send information about a Visitor outside of Australia without their consent, which consent may be implied from the circumstances.

Alliance SI also engages in marketing for its growth and development and as an important part of ensuring that it continues to provide quality services. Personal information held by Alliance SI may be disclosed to entities that assist us in marketing activities, but not for their marketing activities.

We do not sell or rent your personal information to third parties.

Please be aware that when we link on our Website to other sites outside Alliance SI, we cannot be held responsible for their content or for the information stored, accessed, used or disclosed on such websites and that we cannot comment on their privacy policies.

How long do we hold personal information, and when is it destroyed or deidentified?

Alliance SI will take reasonable steps to destroy or de-identify the personal information it holds once the personal information is no longer needed for any purpose for which the personal information may be used or disclosed under this Policy, the Privacy Act or the APPs, save where Alliance SI is required by law or a court order to retain the personal information. A Visitor may unsubscribe at any time, after which Alliance SI will only retain what it is legally obligated to retain.

Automated unsubscribe

At the bottom of every email sent by Alliance SI on behalf of Careers in the Cloud, you will see an ‘unsubscribe’ link. This instantly stops all automated communications to you from Alliance SI, including support for paid products and services.

Manual unsubscribe

If you are a client of Alliance SI and we have a working relationship, hitting unsubscribe does not cease communications, particularly if we are mid-project. These are normal professional communications and will cease at the completion of the project.

Right to be forgotten

You have the right to request ALL your data is stripped of personal identifiers. As a general subscriber this means you’d be deleted from the subscriber list.

Storage and security of personal information

Alliance SI stores personal information in a variety of formats including, but not limited to:

  • databases
  • personal devices, including laptop computers and mobile phones
  • third party storage providers such as cloud storage facilities

Alliance SI uses Hubspot CRM with two factor authentication. Access to the Website by Alliance SI employees and contractors is also via two factor authentication.

Alliance SI takes all reasonable steps to protect the personal information it holds from misuse, loss, unauthorised access, modification or disclosure. Alliance SI’s employees, contractors, volunteers and stakeholders are required to respect the confidentiality of an individual’s personal information that they access, and the privacy of individuals, in the provision of services by or to Alliance SI.

These steps include, but are not limited to:

  • restricting access and user privilege of information by employees, contractors, volunteers and stakeholders depending on their role and responsibilities
  • ensuring employees, contractors, volunteers and stakeholders do not share personal passwords and update their passwords regularly
  • ensuring access to Alliance SI’s premises are always secured
  • ensuring IT and cyber security systems, policies and procedures are implemented and up to date
  • ensuring employees, contractors, volunteers and stakeholders comply with internal policies and procedures when handling personal information
  • undertaking due diligence with respect to third party service providers who may have access to personal information, third party contractors who are engaged to facilitate the provision of services, and cloud service providers to ensure as far as practicable that they are compliant with the APPs or a similar privacy regime
  • the destruction, deletion or de-identification of personal information it holds that is no longer required for the purpose that it was collected unless required to be retained by any other laws

Alliance SI has implemented the Essential Eight, operating at Maturity Model Level 2 as a mitigation strategy against cyber threats.

Responding to data breaches

Alliance SI will take appropriate, prompt action if it has reasonable grounds to believe that a data breach may have or is suspected to have occurred. Depending on the type of data breach, this may include a review of our internal security procedures, taking remedial internal action, notifying affected individuals and the Office of the Australian Information Commissioner (OAIC). If Alliance SI is unable to notify individuals, it will publish a statement on the website and take reasonable steps to publicise the contents of this statement.

Disclosure of personal information

Personal information is used for the purposes for which it was given to Alliance SI, or for purposes which are directly related to one or more of Alliance SI’s operations. Personal information may be disclosed to government agencies, related entities, and other recipients from time to time, if the Visitor has given consent, or would reasonably expect the personal information to be disclosed in that manner.

Alliance SI may disclose personal information without consent or in a manner which a Visitor would reasonably expect if:

  • it is required to do so by law
  • The disclosure will lessen or prevent a serious threat to the life, health or safety of an individual or to public safety
  • Another permitted general situation applies
  • Disclosure is reasonably necessary for a law enforcement related activity
  • Disclosure is part of the process of saving the personal information as part of the provision of cloud services

Disclosure of personal information to overseas recipients

Alliance SI does not disclose information about a Visitor to overseas recipients and will not send information about a Visitor outside of Australia without their consent, which consent may be implied from the circumstances.

The quality of personal information

Alliance SI takes all reasonable steps to ensure the personal information it holds, uses and discloses is accurate, complete and up to date, including at the time of using or disclosing the information.

If Alliance SI becomes aware that the personal information is incorrect or out of date, Alliance SI will take reasonable steps to rectify the incorrect or out of date information.

Access and correction of personal information

Visitors may submit a request/ application to access the personal information held by Alliance SI, or request that Alliance SI change the personal information. Upon receiving such a request, Alliance SI will take steps to verify identity before granting access or correcting any perceived inaccuracy. If the rejection relates to a request/ application to change personal information, a Visitor may make a statement about the requested change and Alliance SI will include this statement with the relevant record. There are some exceptions to these rights, as set out in applicable legislation.

An applicant for access will be required to verify their identity and to specify what information is sought to be accessed, corrected or updated. Alliance SI may charge a fee to cover the cost of verifying an application and locating, retrieving, reviewing and copying any material requested. If the information sought is extensive, Alliance SI will advise the likely cost in advance.

There may be occasions when access is denied. Such occasions would include where release of the information would have an unreasonable impact on the privacy of others. If Alliance SI cannot provide an applicant access to that information, it will provide the applicant with written notice explaining the reasons for refusal.

There are some exceptions to these rights, as set out in applicable legislation.

Complaints

An individual can make a complaint about how Alliance SI manages personal information by notifying Alliance SI in writing as soon as possible. Alliance SI will respond to the complaint within a reasonable time (usually no longer than 30 days). Alliance SI may seek further information in order to provide a full and complete response.

Alliance SI does not charge a fee for the handling of complaints.

If the individual is not satisfied with the response, they may refer the complaint to the OAIC. A complaint can be made using the OAIC Online Privacy Complaint form or by mail, fax or email. A referral to OAIC should be a last resort once all other avenues of resolution have been exhausted.
